As long as you don't use R/3 based services - it works from a license standpoint, you just have to buy a "Portal User Role" for every user accessing the portal. But this user cannot use any ESS-transaction.
But, ESS is HR-related information, so it makes no sense to create an ESS-Portal and then have user access just for non-HR related information.
As far HR is concerned: Especially from a security and legal standpoint, you always need a 1:1 relation of ESS Portal and HR user.
